Introduction

Welcome to Dosio! These Terms and Conditions ("Terms," "Agreement") govern your access to and use of the Dosio mobile application ("App") and our website ("Website") operated by Sustainabel ("we," "our," or "us").

Please read these Terms carefully before using our App or Website. By accessing or using our App or Website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our App or Website.

Important Information

Agreement to Terms

These Terms, together with our Privacy Policy, constitute a legally binding agreement between you and us. By using our App or Website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing, downloading, installing, or using the App or Website, you:

Accept these Terms - You agree to be bound by these Terms and all applicable laws and regulations
Are of legal age - You represent that you are at least 13 years old (or the age of majority in your jurisdiction, whichever is higher)
Have authority - You have the legal capacity and authority to enter into this Agreement
Will comply - You will comply with all applicable laws when using the App or Website

If you are using the App on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

2.1 What Dosio Is

Dosio is a personal health tracking application designed to help you:

Track GLP-1 medication injections (date, time, dosage, injection site)
Monitor side effects and symptoms
Record health metrics (weight, height, blood glucose, blood pressure, calories, protein, water intake)
Manage medication schedules and receive reminders
View insights and trends in your health data
Export your data for personal records or healthcare provider review

2.2 What Dosio Is NOT

IMPORTANT DISCLAIMERS:

NOT a medical device - Dosio is a personal tracking tool and is NOT a medical device, medical treatment, or diagnostic tool
NOT medical advice - Dosio does NOT provide medical advice, diagnosis, or treatment recommendations
NOT a healthcare provider - We are NOT healthcare providers, and we do NOT offer medical services
NOT a substitute for professional care - Dosio is NOT a substitute for professional medical advice, diagnosis, or treatment
NOT emergency services - Dosio cannot and will not provide emergency medical services

YOU SHOULD ALWAYS CONSULT WITH A QUALIFIED HEALTHCARE PROVIDER before making any medical decisions, starting or changing medications, or if you have any questions about your health.

IF YOU HAVE A MEDICAL EMERGENCY, CONTACT EMERGENCY SERVICES IMMEDIATELY (e.g., call 911 in the United States).

3. Eligibility

3.1 Age Requirements

You must be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) to use the App or Website.

If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that:

You have reviewed these Terms with a parent or legal guardian
Your parent or legal guardian understands and agrees to these Terms
Your parent or legal guardian will be responsible for your use of the App or Website

3.2 Prohibited Users

You may NOT use the App or Website if:

You are under 13 years old (or the age of majority in your jurisdiction)
You are prohibited from using the App or Website under applicable laws
You have been previously banned or suspended from using the App or Website
You are located in a jurisdiction where use of the App or Website is prohibited

3.3 Account Requirements

To use certain features of the App, you must:

Create an account using Apple Sign-In or Google Sign-In
Provide accurate and complete information
Maintain the security of your account
Notify us immediately of any unauthorized access to your account

4. User Accounts

4.1 Account Creation

To use the App, you must create an account by signing in with:

Apple Sign-In - Your Apple ID (iOS devices)
Google Sign-In - Your Google account

Note: We do NOT create or manage your Apple or Google account. Your account is managed by Apple or Google, respectively, and is subject to their terms and conditions.

4.2 Account Security

You are responsible for:

Maintaining confidentiality - Keeping your account credentials secure
All activities - All activities that occur under your account
Unauthorized access - Notifying us immediately if you suspect unauthorized access
Accurate information - Providing accurate and up-to-date information

We are NOT responsible for any loss or damage arising from unauthorized use of your account.

4.3 Account Termination

You may delete your account at any time through the App settings. We may also suspend or terminate your account if you violate these Terms. See Section 11 (Termination) for more information.

5. Subscriptions and Payments

5.1 Subscription Plans

Dosio offers the following subscription plans:

Monthly Plan - Monthly subscription with 7-day free trial
Yearly Plan - Annual subscription with 7-day free trial (discounted rate)

Prices may vary by location and are subject to change. Current pricing is displayed in the App before purchase.

5.2 Free Trial

Duration: 7 days from the date you start your trial
Access: Full access to all premium features during the trial period
No charge: You will NOT be charged during the trial period
Auto-renewal: Your subscription will automatically renew at the end of the trial period unless cancelled
One trial per user: Each user is eligible for one free trial per subscription plan
Cancellation: You may cancel at any time during the trial period without being charged

Important: Your trial will automatically convert to a paid subscription at the end of the 7-day period unless you cancel before the trial expires.

5.3 Subscription Terms

Billing: Subscriptions are billed through Apple App Store (iOS) or Google Play Store (Android)
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled
Renewal charges: You will be charged the subscription fee for the next billing period before the renewal date
Price changes: We reserve the right to change subscription prices. We will notify you of any price changes in advance
Cancelled subscriptions: If you cancel your subscription, you will retain access to premium features until the end of your current billing period

5.4 Payment Processing

Payment method: Payment is processed through Apple App Store or Google Play Store
Payment responsibility: You are responsible for all charges incurred under your account
Payment authorization: By subscribing, you authorize Apple or Google to charge your payment method
Refunds: Refunds are subject to Apple App Store or Google Play Store refund policies

5.5 Subscription Cancellation

How to Cancel:

iOS: Go to Settings → [Your Name] → Subscriptions → Dosio → Cancel Subscription
Android: Go to Google Play Store → Subscriptions → Dosio → Cancel Subscription
In-App: You can access subscription management through the App's settings

After Cancellation:

You will retain access to premium features until the end of your current billing period
Your subscription will NOT renew after the current period ends
You can resubscribe at any time

5.6 Subscription Refunds

Refund requests are handled by:

Apple App Store - For iOS subscriptions (subject to Apple's refund policy)
Google Play Store - For Android subscriptions (subject to Google's refund policy)

We do NOT process refunds directly. Contact Apple or Google support for refund requests.

5.7 Subscription Changes

We reserve the right to:

Change subscription prices with advance notice
Modify subscription plans and features
Discontinue subscription plans (with advance notice and prorated refunds, if applicable)

6. Premium Features

6.1 Premium Features

Premium features include:

Apple Health Sync (iOS) - Sync health data with Apple Health
Health Connect Sync (Android) - Sync health data with Health Connect
Data Export - Export your data as formatted PDF reports
Advanced Charts - Medication level graphs and advanced health metrics charts
Side Effects Correlation - Advanced side effects analysis and correlation insights

Note that whether a feature belongs to the Premium or the Free tier is subject to change.

6.2 Free Features

Free features include:

Basic medication tracking
Basic side effects tracking
Manual health metrics entry
Basic data export (CSV format)
Medication reminders

6.3 Feature Access

Free Trial: Full access to all premium features
Active Subscription: Full access to all premium features
Cancelled Subscription: Access to premium features until subscription period ends
Expired Subscription: Limited to free features only
No Subscription: Limited to free features only

7. User Responsibilities and Conduct

7.1 Acceptable Use

You agree to use the App and Website:

Lawfully - In compliance with all applicable laws and regulations
Responsibly - For personal, non-commercial purposes only
Respectfully - In a manner that does not harm others or interfere with the service
Accurately - By providing accurate and truthful information

7.2 Prohibited Activities

You agree NOT to:

Violate laws - Use the App or Website in violation of any applicable laws
Infringe rights - Infringe on the intellectual property rights of others
Harm others - Use the App or Website to harm, threaten, or harass others
Reverse engineer - Reverse engineer, decompile, or disassemble the App or Website
Interfere with service - Interfere with or disrupt the App, Website, or servers
Unauthorized access - Attempt to gain unauthorized access to accounts, systems, or networks
Automated access - Use bots, scripts, or automated tools to access the App or Website
Commercial use - Use the App or Website for commercial purposes without our permission
Data scraping - Scrape, harvest, or collect data from the App or Website
Impersonate - Impersonate others or provide false information
Circumvent security - Attempt to circumvent security measures or access controls
Malicious software - Introduce viruses, malware, or other harmful code

7.3 Health Data Accuracy

You are solely responsible for:

Accuracy - The accuracy of all health and medication data you enter
Completeness - Providing complete and truthful information
Medical decisions - Making medical decisions based on your data (in consultation with healthcare providers)
Emergency situations - Seeking appropriate medical care in emergency situations

We are NOT responsible for any consequences arising from inaccurate, incomplete, or missing data.

8. Intellectual Property

8.1 Our Rights

The App, Website, and all content, features, and functionality are owned by us or our licensors and are protected by:

Copyright laws
Trademark laws
Trade secret laws

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use - Access and use the App and Website for personal, non-commercial purposes
Download and install - Download and install the App on your personal devices

This license does NOT include the right to:

Copy, modify, or create derivative works
Sell, rent, lease, or sublicense
Use for commercial purposes
Remove copyright or proprietary notices

8.3 Your Content

You retain ownership of any data you enter into the App ("Your Content"). By using the App, you grant us a license to:

Store - Store Your Content on our servers
Process - Process Your Content to provide the service
Display - Display Your Content to you through the App
Backup - Backup Your Content for data recovery purposes

This license is limited to providing the service and terminates when you delete your account or Your Content.

8.4 Feedback

If you provide feedback, suggestions, or ideas about the App or Website ("Feedback"), you agree that:

We may use your Feedback without compensation or attribution
We are not obligated to implement your Feedback
Your Feedback becomes our property

9. Health Information Disclaimer

9.1 NOT Medical Advice

THE APP AND WEBSITE DO NOT PROVIDE MEDICAL ADVICE.

The App and Website are intended for personal health tracking purposes only and are NOT intended to:

Diagnose, treat, cure, or prevent any medical condition
Replace professional medical advice, diagnosis, or treatment
Provide emergency medical services

9.2 Always Consult Healthcare Providers

YOU SHOULD ALWAYS:

Consult with qualified healthcare providers before making medical decisions
Seek professional medical advice for any health concerns
Follow the advice of your healthcare providers
Not rely solely on the App or Website for medical decisions

9.3 Emergency Situations

IF YOU HAVE A MEDICAL EMERGENCY:

Contact emergency services immediately (e.g., call 911 in the United States)
Do NOT rely on the App or Website for emergency medical assistance
Seek immediate medical attention from qualified healthcare providers

9.4 Data Not Diagnostic

The data, charts, and insights provided by the App are:

For informational purposes only
NOT diagnostic tools
NOT intended to diagnose medical conditions
NOT a substitute for professional medical evaluation

10. Limitation of Liability

10.1 NO WARRANTIES

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Warranties of fitness for a particular purpose
Warranties of non-infringement
Warranties that the App or Website will be uninterrupted, error-free, or secure

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Personal injury or death
Damage to property
Claims arising from your use of the App or Website

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

10.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10.4 Medical Disclaimer of Liability

WE ARE NOT LIABLE FOR ANY:

Medical decisions made based on data from the App
Health outcomes or consequences of using the App
Errors or inaccuracies in data you enter
Failure to seek appropriate medical care
Delays or failures in delivering reminders or notifications

11. Indemnification

You agree to indemnify, defend, and hold harmless Sustainabel and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

Your use of the App or Website
Your violation of these Terms
Your violation of any rights of others
Any content you submit or transmit through the App or Website

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

Deleting your account - Through the App settings → Delete Account
Uninstalling the App - Removing the App from your device (does NOT delete your account or data)
Stopping use - Simply stop using the App or Website

Note: Deleting your account will permanently delete all your data. This action cannot be undone. We advise to export your data before you delelete your account.

12.2 Termination by Us

We may suspend or terminate your account or access to the App or Website at any time, with or without notice, if you:

Violate these Terms
Violate any applicable laws
Engage in fraudulent, harmful, or illegal activity
Fail to pay subscription fees (if applicable)
Breach any other agreement with us

12.3 Effect of Termination

Upon termination:

Your right to use - Your right to use the App and Website immediately ceases
Account access - Your account may be suspended or deleted
Data deletion - Your data may be deleted (subject to our data retention policies)
Subscriptions - Your subscription will NOT be refunded (except as required by law)
Surviving provisions - Certain provisions will survive termination (see Section 13.4)

12.4 Data After Termination

After account deletion:

Your personal data will be permanently deleted (subject to backup retention)
Anonymized, aggregated data may be retained for analytics
You can export your data before deletion (see our Privacy Policy)

13. Changes to Terms

13.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes:

We will update - We will update the "Last Updated" date at the top of these Terms
We will notify you - We will notify you via:
- Email (if you have provided your email address)
- In-app notification
- Prominent notice on our Website

13.2 Acceptance of Changes

Your continued use of the App or Website after the changes become effective constitutes your acceptance of the updated Terms.

If you do not agree with the changes, you may:

Stop using the App and Website
Delete your account (see Section 12.1)

13.3 Material Changes

For material changes to these Terms, we will:

Require explicit acknowledgment (if required by law)

14. Governing Law

14.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.

14.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Nijmegen, The Netherlands for any disputes arising out of or relating to these Terms.

15. Dispute Resolution

Before filing a claim, you agree to:

Contact us first - Contact us at info@sustainabel.com to attempt to resolve the dispute informally
Good faith negotiations - Engage in good faith negotiations for at least 30 days.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and Website and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may NOT assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without your consent.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

Natural disasters
Acts of war or terrorism
Internet or telecommunications failures
Government actions
Pandemics or public health emergencies

16.6 Third-Party Services

The App and Website may integrate with third-party services (e.g., Apple Health (iOS), Health Connect (Android), Google Sign-In). Your use of third-party services is subject to their terms and conditions, and we are not responsible for their actions.

16.7 Export Restrictions

The App and Website may be subject to export restrictions. You agree to comply with all applicable export control laws and regulations.

16.8 Language

These Terms are written in English. If translated into other languages, the English version shall prevail in case of conflict.
